KEKUATAN HUKUM DARI BANTUAN HUKUM OLEH LEMBAGA BANTUAN HUKUM YANG BELUM TERVERIFIKASI BERDASARKAN UNDANG-UNDANG NOMOR 16 TAHUN 2011 TENTANG BANTUAN HUKUM (STUDI PADA LEMBAGA KONSULTASI DAN BANTUAN HUKUM FAKULTAS HUKUM UNIVERSITAS PROKLAMASI 45 YOGYKARTA)

Abstract
The purpose of this study was to analyze the legal force of legal aid provided by the unverified by Legal Aid Institute (LBH) in the Ministry of Law and Human Rights (Kemekumham). LBH is institution that provides legal aid for justice seekers without receiving honorarium payments, to protect the public from repression in the name of the law that often befall them. Article 8 Paragraph (2) of Law Number 16 Year 2011 concerning legal aid stipulates the requirements of the Legal Aid Provider of which is accredited under this law. In fact, there are still many LBHs as legal aid providers, unverivied in Kemenkumham, including the Consultation and Aid Institution of Faculty of Law Universitas Proklamasi 45 Yogyakarta (LKBH UP 45). However, LKBH UP 45 as an institution that has not been accredited, has been accompanying clients in court. Legal assistance provided by LKBH FH UP45 until the case gets a permanent legal decision. This proves that verification does not affect the legal force of legal aid. The difference between verified and unverified LBHs is only in the case of state funding to the verified LBH. All legal aid institutions, whether verified or unverified, have legal power of legal aid as long as the institution is already incorporated. LKBH FH UP45 has been in the institutional structure, in this case the University of Proclamation 45 Yogyakarta, so that according to Article 13 paragraph (2) of the Regulation of the Minister of Justice and Human Rights of the Republic of Indonesia Number 3 of 2013 on the Procedures for Verification and Accreditation of Legal Aid Institutions or Organizations Community, LKBH FH UP45 is a legal entity.
